Terms of Service

Using BibSafe Means Accepting These Terms

These Terms of Service (the “Terms”), in conjunction with our Privacy Policy, constitute the entire agreement (the “Agreement”) between Tjark Nielsen (Sole Proprietor Business) ("Tjark Nielsen", “BibSafe”, “we”, “us”, or “our”) and you (“you”, “your”, or the “User”). These Terms govern your use of the bibsafe.com website, the BibSafe web application, and/or the BibSafe services (collectively, the “Service”).

By using the Service, you acknowledge that you have read and agreed to these Terms, so please read them carefully. We may update these Terms from time to time. Unless otherwise required by law, we will notify you before making such changes and give you an opportunity to review them before they go into effect. Once any updated Terms are in effect, you will be bound by them if you continue to use the Service. If you do not agree to our updated Terms, you can delete your account at any time.

Communications

You acknowledge and agree that we may send you emails related to your account and/or the Service. If you represent a for-profit company or academic institution, you agree that we can use your organization's name or logo in our advertising. This permission will continue unless and until you notify us in writing to cease the use of your organization's name or logo.

Intellectual Property

We claim no intellectual property rights over the data (such as academic references or other content) you provide to the Service.

You acknowledge and agree that we own all right, title, and interest in and to the Service, including without limitation all intellectual property rights. You agree that you will not copy, reproduce, alter, reverse engineer, clone, or modify the Service or create derivative works from the Service.

Use License

BibSafe offers both a free service option with a limited set of features and rate limits, and paid license options that provide access to an extended set of features and higher rate limits. The specifics of these features and rate limits for each plan can be found on our pricing page.

Upon subscribing to a paid plan or purchasing a paid license, Users are granted a non-exclusive, non-transferable, and time-limited right to use BibSafe’s extended features and higher rate limits. This license is associated with a single user account or, where applicable, an organization account. License durations and included features vary depending on the selected plan.

Offline use of the Service is not possible. Access to and use of the Service requires an active internet connection.

Accounts, Passwords, and Security

Registration is required in order to use the Service, including the free plan. You must create a user account to access BibSafe.

You are responsible for keeping your password secure, and you are solely and strictly liable for any activity that occurs under your username. You also agree not to access, or attempt to access, other Users’ accounts and/or data.

When you delete any of your data in the Service or if you delete your user account, then this data will be flagged for removal and will be deleted from our systems within 30 days, and from backups within 90 days. A minimal record may remain in our CRM system for administrative and accounting purposes. You can request its deletion with a formless message to our support email.

User Responsibilities and Acceptable Use

Scope of the Service

  • A text field or similar interface to enter academic references and related bibliographic data;
  • Automated checks, verifications, or transformations of such references (for example, format checks, metadata lookups, or consistency checks);
  • A results section where processed or verified references are displayed and may be exported or documented.

Responsibilities for References and Results

Responsibility for Input Data

You are solely responsible for the accuracy, completeness, and legality of all references and other data you enter into the Service and for ensuring you have necessary rights to submit such data.

Responsibility for Storing and Securing Results

You are solely responsible for storing, backing up, and securing any results you wish to retain. We do not guarantee long-term storage or availability of specific results.

Academic Integrity and Compliance

The Service supports reference management and verification but does not replace your academic judgment. You are responsible for compliance with all applicable rules and for verifying outputs before use.

Acceptable Use and Prohibited Activities

You agree not to use the Service:

  • For any illegal purpose or in violation of any applicable law or regulation;
  • To upload or submit content that infringes the rights of any third party;
  • To submit personal data of third parties without appropriate legal basis or consent;
  • To interfere with or disrupt the integrity or security of the Service.

Liabilities and Enforcement

We are not responsible for the content of the references you provide or for decisions you make based on the results generated by the Service. We may suspend or terminate accounts used in violation of these Terms or applicable law.

Payment Terms

For Customers Using Free Plans

We do not require a payment method when using our free offering. Access to free plans is subject to the feature set and rate limits described on our pricing page and in these Terms.

For Customers on Subscription Plans

We offer a 14-day refund policy if the product has not been used within this period. Subscriptions auto-renew until cancelled before the next billing date.

For Customers on Pay-As-You-Go Plans

All pay-as-you-go sales are final except where required by law.

Chargeback / Refund Policy

Eligible refunds are issued to the original payment method per these Terms. Zero tolerance for invalid chargebacks; violators may be banned.

Service Availability and Limitations

We strive for high availability. Service statistics will be shared once available; we have just launched and are scaling to meet demand.

Liability

The Service is provided “as is” without warranties. We and our suppliers are not liable for indirect, special, incidental, consequential, or punitive damages to the fullest extent permitted by law. Some jurisdictions do not allow certain exclusions; in such cases our liability is limited to the maximum permitted by law.

Governing Law

These Terms are governed by the laws of Germany. You submit to the exclusive jurisdiction of the courts there.

Statute of Limitations

Any claim related to the Service must be filed within one (1) year after it accrued.

Right to Terminate

We may suspend or terminate your right to use the Service and these Terms immediately upon written notice for any breach.

Severability

If any provision of these Terms is unlawful, void, or unenforceable, the remaining provisions remain in effect.

Miscellaneous

These Terms constitute the entire agreement. Additional or different terms you propose are rejected. Failure to exercise a right is not a waiver. Titles are for convenience only. These Terms are not intended to confer third-party rights. Assignment requires our prior written consent.
